Etched from the Soul creates contemplative guides, companion decks, books, and hand-finished artifacts intended to accompany thresholds of grief, memory, meaning, and becoming.
These Terms and Conditions form a legally binding agreement between you and Etched from the Soul. They are also part of the shared agreements that hold this space — they exist to make the practical side of our exchange clear and fair while allowing the work itself to remain what it was created to be.
By placing an order, downloading a product, or using this website, you agree to the terms below.
1. About These Products
Etched from the Soul offers both digital and physical products.
Digital offerings may include Threshold Companion Guides and other downloadable contemplative materials.
Physical offerings may include books, companion decks, printed materials, limited-run pieces, personalized editions, and other hand-assembled or hand-finished works.
2. Digital Delivery
Digital products are delivered electronically after payment has been successfully processed, typically through a download link, order confirmation, email, or a combination of these.
Because digital products become available upon delivery, digital purchases are final once the file or download access has been provided.
If you are charged more than once for the same purchase, receive an incorrect file, or encounter a technical problem that prevents access and that we are unable to resolve, please contact Etched from the Soul at crystal@etchedfromthesoul.com. We will review the circumstances and make appropriate corrections or refunds where warranted.
Nothing in this policy limits any rights available to you under applicable law.
3. Physical Products, Processing & Shipping
Physical products are currently shipped within the United States only.
Because Etched from the Soul produces small-run, printed, personalized, and hand-finished work, preparation times may differ from one offering to another. The estimated processing time for an item will be stated on the product page, at checkout, or in the order information when applicable.
Processing time is separate from the carrier’s delivery time.
If an unexpected delay prevents us from shipping within the stated timeframe, we will contact you with an updated shipping estimate and give you the opportunity to accept the delay or cancel the unshipped portion of the order for a refund.
Once an order has been accepted by the shipping carrier, delivery timing and carrier handling are outside our direct control. Etched from the Soul is not liable for loss, theft, or damage that occurs in transit, though we may assist in filing a carrier claim.
4. Returns, Damage & Fulfillment Errors
Because many Etched from the Soul products are printed in small runs, assembled by hand, or prepared specifically for an order, we do not accept returns or exchanges for change of mind.
If your order arrives damaged, defective, or materially different from what you ordered, please contact us promptly after delivery at crystal@etchedfromthesoul.com so we can work toward a resolution.
If a package is lost or significantly delayed in transit, please contact Etched from the Soul at crystal@etchedfromthesoul.com. We may assist with a carrier claim or another appropriate next step.
We may request photographs or other reasonable information needed to understand shipping damage or a fulfillment error. In most cases, this is enough and the item does not need to be sent back. If we do ask that an item be returned, we will provide instructions and cover the cost of return shipping when we determine the issue was caused by Etched from the Soul, such as a damaged, defective, or incorrect item.
5. Personalized & Legacy Pieces
Products containing personalized dedications, names, inscriptions, selected content, or other custom elements are created specifically for the person for whom they are ordered.
When a proof or personalization preview is provided, please review names, dates, wording, spelling, and other details carefully before approval.
Once personalization or custom production has begun, these items cannot be cancelled, returned, or exchanged, except where required by law or in the case of an error introduced by Etched from the Soul.
6. Orders, Pricing & Payment
All prices are stated in United States dollars unless otherwise indicated.
Prices, product availability, editions, and offerings may change without notice.
Applicable sales tax is calculated and collected as required.
Payment is processed through the payment services offered at checkout.
Receiving an order confirmation email means we have received your order; it does not guarantee that the order has been accepted. Etched from the Soul reserves the right to decline or cancel an order when necessary because of an obvious pricing or listing error, unavailable inventory, an inability to fulfill the requested personalization, suspected fraudulent activity, or another circumstance that makes fulfillment impracticable — including after a confirmation email has been sent.
If we cancel an order after payment has been collected, the amount paid for the cancelled portion of the order will be refunded.
7. Digital Personal-Use License & Intellectual Property
Purchasing a digital product gives you a limited license to use that product for your own personal use. Ownership of the underlying writing, artwork, design, photographs, illustrations, exercises, companion materials, and other original content remains with Etched from the Soul or the applicable rights holder.
You may download and print purchased digital materials for your own personal use. This license does not permit reproduction for other people, group distribution, or professional or commercial use unless separately authorized.
Unless express written permission or a separate license says otherwise, digital materials purchased from Etched from the Soul may not be:
- resold or redistributed;
- uploaded to a shared drive, public website, membership platform, or file-sharing service;
- reproduced for a group, workshop, course, classroom, organization, or commercial offering;
- altered and represented as another person’s work; or
- used to create derivative commercial products.
Purchase of a product does not transfer copyright or other intellectual-property rights.
Additional licenses for professional, organizational, group, or other uses may be offered separately in the future.
8. Website Content
The writing, artwork, photography, graphics, product designs, downloadable materials, branding, and other original content appearing on the Etched from the Soul website are protected intellectual property.
You are welcome to share links to Etched from the Soul’s publicly available pages and offerings. Reproducing substantial portions of the site’s original content, artwork, or downloadable materials without permission is not permitted except as allowed by law.
9. Website Use
Please use this website in a manner consistent with its purpose: a place to browse, reflect on, and purchase Etched from the Soul’s offerings.
The following are not permitted:
- accessing the website in a way that could damage, disable, overburden, or interfere with its operation, or attempting to bypass its security features;
- introducing viruses, malicious code, or other material harmful to the website or its users;
- using automated means — bots, scrapers, crawlers, or similar tools — to collect content, data, or information from the website without our prior written permission;
- using content from this website to train, fine-tune, or otherwise develop an artificial intelligence or machine-learning model without our prior written permission; or
- copying, reproducing, or distributing substantial portions of the website’s content in a manner not otherwise permitted by these Terms.
Etched from the Soul may suspend or restrict access to the website for anyone who violates this section.
10. Account & Order Information
If you create an account or provide information during checkout, you are responsible for providing information that is accurate enough for us to process and deliver your order.
If you create login credentials, you are responsible for keeping them reasonably secure.
Please contact us if you discover an error in an order or shipping address. We will make reasonable efforts to correct it before fulfillment, although changes may not be possible once production or shipment has begun.
11. Privacy & Staying Connected
Information provided while placing an order is used as described in the Etched from the Soul Privacy Policy.
Providing an email address so that we can process an order, deliver a digital purchase, or communicate about fulfillment does not by itself mean that you have chosen to receive ongoing reflections, announcements, or promotional communications.
When you separately choose to stay connected with Etched from the Soul, you may receive occasional communications about new guides, releases, reflections, or related offerings.
You may unsubscribe from those communications at any time.
12. A Note on What This Work Is — and Is Not
Etched from the Soul offers contemplative, literary, artistic, and creative materials for reflection and personal use.
These materials may companion experiences of grief, transition, memory, relationship, meaning-making, or personal inquiry, but they are not psychotherapy, medical care, psychological treatment, diagnosis, crisis intervention, or individualized professional advice.
Purchasing, reading, or interacting with Etched from the Soul products does not establish a therapist-client relationship or other professional care relationship with Etched from the Soul or its creator.
When circumstances call for medical, psychological, legal, financial, or other professional care, please seek support from a qualified professional appropriate to your needs.
13. Limitation of Liability
This website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.
To the fullest extent permitted by applicable law, Etched from the Soul will not be liable for indirect, incidental, special, or consequential losses arising from the use of this website or its products.
Nothing in these Terms is intended to exclude or limit responsibility that cannot lawfully be excluded or limited.
14. Governing Law
These Terms and any dispute arising from them are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute arising from these Terms or your use of this website will be brought in a court located in Nebraska, unless applicable law requires otherwise.
15. Severability
If any provision of these Terms is found by a court or other authority of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
16. Entire Agreement & No Waiver
These Terms, together with the Etched from the Soul Privacy Policy and any other policies referenced on this website, make up the entire agreement between you and Etched from the Soul regarding your use of the website and purchase of products, and replace any earlier understanding on that subject.
If Etched from the Soul does not enforce a provision of these Terms on a particular occasion, that does not waive our right to enforce it at another time.
17. Changes to These Terms
Etched from the Soul may update these Terms as the work, shop, or applicable requirements evolve.
The version in effect at the time of a purchase will apply to that purchase. The current published version will govern future purchases and future use of the website.
